Conveyancing

For most of us, the sale and/or purchase of our home is one of the most important – and stressful - transactions of our lives, and the Spanish housing market and legal system can be a minefield to the uninitiated. We at Sun Services are fully conversant and up-to-date with the necessities and vagaries on all aspects of purchasing and selling, including:

Power of Attorney

Should it prove difficult for you to attend the legal signing of any documents - due to, for example, work or family commitments elsewhere – it is possible to appoint someone else to sign on your behalf. Power of Attorney can be granted to anyone you care to choose, be they family, friend or any representative you feel confident will consider your best interests. We can stand as Power if you wish.

It is necessary for you to appear in person to sign the Power of Attorney, either at a Spanish Notary or at a Notary in your home country.

Wills

The importance of making a Will when any assets are held in Spanish territory cannot be overstressed.

Following the death of anyone owning a property in Spain, it will not be possible to legally sell said property until the inheritance has been sorted out. When there is a Will in place, this takes approximately six months. Without a Will, it becomes a nightmare which can take considerably longer.

The Will is written in such a way that it only affects Spanish assets – property, bank accounts etc. It will not negate any British Will already in force which covers non-Spanish belongings.

We will listen to your wishes and prepare the necessary paperwork, after which we will escort you to the Notary to sign the formal papers. This usually happens after a few days, but can be done the next working day, if necessary. The legally binding section of the Will is written in Spanish on the left of each page, with an English translation showing on the right. You will receive a Copia Simple of the Will, whereas the original document will be stored permanently at the Notary's office and a copy in the Central Registration Office in Madrid.

Inheritance / Probate

We can assist you through the steps necessary to settle any Spanish estate. It is not a prior requirement that you have made a Will through us.

Legalising Businesses

When working in Spain, other than when contracted by an employer, it is necessary to either register yourself individually as self-employed or to set up a registered company. We can guide you through the appropriate procedure with a minimum of effort on your part.
